These terms cover this website and nothing else. Each product we run has its own terms of service, published on its own site.

1. Who we are

This website, rowedigital.net, is published by The Trustee for Rowe Digital Trust, ABN 13 313 912 737, of Brisbane, Queensland, Australia (we, us). In these terms, you means the person reading the site.

We trade under the business names BubSync and My Energy Agent. This website describes those products. It does not sell them.

2. What these terms cover

These terms apply to your use of this website. By browsing it, you accept them.

It is worth being precise about what this site is, because it changes what you are agreeing to:

  • There are no accounts on this website and nothing to sign in to.
  • Nothing is sold here. We take no payments, run no checkout, and hold no card details.
  • There is no forum, no comment box and nothing for you to upload or publish.
  • The site is a set of static pages. It exists to explain who we are and what we build, and to point you at the right product.

3. Our products have their own terms

Each product is a separate service with its own accounts, its own billing and its own agreement with you. These website terms do not govern any of them. When you create an account, subscribe or pay for something, the agreement you enter is the one published by that product:

Anything to do with a subscription — what it costs, how it renews, how to cancel it, when a refund is due, what happens to your data — is answered by that product's terms and by the product's own support team, not here. Where a description on this website differs from the product's own terms, the product's terms win.

4. Using this website

You may read, print and share these pages for your own information. Our Acceptable Use Policy sets out the short list of things you must not do with the site, and it forms part of these terms.

5. Our content and brand

We own the text, design, code, logos and images on this website, other than material licensed to us by third parties. The typefaces used here are licensed separately under the SIL Open Font License.

You may quote us with attribution and a link. You may not copy the site wholesale, republish it as your own, or use our names, logos or product branding in a way that suggests we endorse you or are connected with you.

6. Accuracy of what you read here

We try to keep this site accurate, and we correct mistakes when we find them. Even so, the product descriptions here are summaries. Features, availability, plans and prices change, and the product's own website is always the current record. Check there before you rely on anything.

7. Not advice, and not an offer

Nothing on this website is professional advice. In particular, nothing here is medical, legal, financial or energy advice, and our articles are general commentary rather than guidance for your circumstances. Get advice from someone qualified before you act on anything you read here.

Nothing on this website is an offer capable of acceptance. An agreement is formed only when you subscribe to a product, on that product's terms.

We link to our product sites and to third parties, including regulators, service providers and app stores. We do not control those sites and are not responsible for their content, terms or privacy practices. A link is not an endorsement.

9. Availability

We try to keep this website up, but we do not promise uninterrupted access. We may change, move or remove pages at any time. If a link that used to work now returns a 404, tell us at hello@rowedigital.net and we will fix it.

10. Privacy

This website sets no cookies, runs no analytics and asks you for nothing. What little is handled, and why, is set out in our website privacy policy. Personal information you give a product is covered by that product's privacy policy instead.

11. Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded. Where we are permitted to limit a remedy, our liability is limited, at our option, to supplying the service again or paying the cost of having it supplied again.

12. Limitation of liability

Subject to section 11, and to the maximum extent permitted by law:

  • this website is provided on an "as is" and "as available" basis, without warranties of any kind;
  • we are not liable for any loss arising from your use of, or reliance on, this website, including indirect or consequential loss; and
  • our total liability in connection with this website is limited to AUD $100.

13. Changes to these terms

We may update these terms. The current version is always the one on this page, and the "last updated" date at the top reflects it. Continuing to use the site after a change means you accept the updated terms.

14. Governing law

These terms are governed by the laws of Queensland, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that place and of the Commonwealth of Australia.
